These Terms of Use govern your access to and use of coloradoluxurybath.com and the referral and coordination services offered by Colorado Luxury Bath (“Colorado Luxury Bath,” “we,” “us,” or “our”). Please read them carefully.
Acceptance of Terms
By accessing this website, submitting a form, or requesting an introduction to an installer, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the site or our services.
You represent that you are at least 18 years old and that the information you provide to us is accurate.
Description of Service
Colorado Luxury Bath is a marketing and referral service. We provide advertising, appointment setting, installer vetting, concierge matchmaking, and project coordination.
We do not perform construction, installation, demolition, plumbing, electrical, or other remodeling work, and we are not a licensed general contractor. All physical work is performed by independent, Colorado-licensed and insured installers.
Colorado Luxury Bath is not a party to any construction contract between you and an installer. That agreement is solely between you and the installer and governs scope, pricing, schedule, changes, payments, and warranties.
No Guarantee
Colorado Luxury Bath does not guarantee, and makes no promise regarding:
- The performance, workmanship, conduct, or availability of any installer
- Project pricing, quotes, estimates, or cost outcomes
- Project approval, scheduling, or completion timelines
- Financing approval, rates, or terms offered by third-party lenders
- Final results, materials, finishes, or the condition of completed work
Any timeline, price, promotion, or outcome described on this site is illustrative only and is subject to your installer's own terms and an evaluation of your home.
Disclaimer of Warranties
The website and the referral service are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any content is complete or current. Colorado Luxury Bath does not issue construction or product warranties; those are provided by your installer and by product manufacturers.
Limitation of Liability
To the fullest extent permitted by Colorado law, Colorado Luxury Bath's total liability to you for any claim arising out of or relating to the website, the referral service, or any introduction to an installer is limited to the greater of $100 or the total amount you paid Colorado Luxury Bath directly — which is normally zero, because homeowners pay us nothing directly.
Colorado Luxury Bath is not liable for construction defects, faulty or incomplete workmanship, delays, cost overruns, change orders, property damage, personal injury, lien claims, permitting or code issues, or any act, omission, or conduct of an installer, lender, or other third party.
We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits or lost use, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Colorado Luxury Bath and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the site, your breach of these Terms, or any dispute between you and an installer, lender, or other third party.
Homeowner Responsibilities
Before work begins, you are responsible for:
- Verifying the installer's current license or registration and insurance coverage
- Reading the construction agreement in full, including scope, price, payment schedule, timeline, change-order terms, and warranty coverage, before signing
- Reviewing any financing documents directly with the lender
- Communicating directly with your installer regarding construction concerns
Credentials and coverage can change over time. We encourage you to confirm them independently before signing.
Intellectual Property
All content on this site — including text, photographs, graphics, logos, and the Colorado Luxury Bath name and marks — is owned by Colorado Luxury Bath or its licensors and is protected by copyright, trademark, and other laws.
You may view and print pages for personal, non-commercial use. You may not copy, reproduce, republish, or use our content or marks for any other purpose without our prior written permission.
Governing Law and Venue
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. You agree that the exclusive venue for any action arising out of or relating to these Terms or the referral service is the state or federal courts located in El Paso County, Colorado.
Dispute Resolution
If you have a concern, please contact us first — most matters are resolved quickly and informally. You agree to give us written notice describing the issue and at least thirty (30) days to respond before initiating any formal proceeding.
Disputes concerning construction work, workmanship, pricing, or schedule are between you and your installer and are governed by your construction agreement with that installer.
Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they were last revised. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
